0. Important Notices

0.1. These Terms of Use (the Terms) govern access to and use of AUTO.AE digital services, including the website, mobile applications, and all related sections/subdomains.

0.2. Language priority: This English version is the master and prevails over any translated versions. In case of any inconsistency, the English version shall apply.

0.3. Acceptance: By accessing or using AUTO.AE (including browsing), you confirm that you have read, understood, and accepted these Terms in full and without reservation.

0.4. If you do not agree with these Terms, you must immediately stop using AUTO.AE.

0.5. Electronic form: These Terms are deemed concluded in electronic form at the moment you start using AUTO.AE.

1. Service Operator (AUTO.AE)

1.1. AUTO.AE is operated by AUTOAE PORTAL L.L.C (Dubai Mainland), License No. 1094203.

2. Definitions

2.1. AUTO.AE / Service / Platform means the website auto.ae, the AUTO.AE and AUTO.AE Business mobile applications, and all related subdomains, locales, sections (sale, rent, VIP plates, showrooms, catalog, blog, etc.), and related domains including auto.qa.

2.2. User means any person accessing or using the Service (registered or not).

2.3. Account means a User account within the Service.

2.4. Private User means a User placing listings for personal, non-systematic commercial purposes.

2.5. Business User / Business Account means a User placing listings in the course of business/commercial activity (including showrooms, dealers, rental companies, VIP plate sellers, etc.), including via AUTO.AE Business.

2.6. Listing means a publication about an item/offer available in the Service (sale, rent, VIP plates, etc., as supported by the Service).

2.7. Content means any data/material provided by a User through the Service (text, photos, videos, documents, messages, vehicle details, VIN/chassis, price, etc.).

2.8. Wallet means a User's internal balance within the Service used to pay for paid services.

2.9. Moderation means any automated and/or manual actions by AUTO.AE to review and manage Content/Listings (including edits, category changes, limiting visibility, "freezing", removing, blocking accounts, etc.).

3. Service Description

3.1. AUTO.AE provides an online platform (marketplace) enabling Users to publish and view listings for vehicle sale and rental, VIP plates, and other features shown in the AUTO.AE interface.

3.2. AUTO.AE may add, change, suspend, or discontinue any features/sections at its sole discretion.

4. Registration and Accounts

4.1. Registration/login may be available via the methods supported by the Service (email, phone, Apple/Google/other options, depending on implemented functionality).

4.2. One User — one Account. Creating multiple accounts, evading bans, mass registrations, or attempts to manipulate the Service are prohibited.

4.3. The User is responsible for safeguarding access credentials and for all actions performed through the Account.

4.4. The User must provide accurate information and keep it up to date.

4.5. AUTO.AE may (but is not obliged to) request documents and information confirming identity/authority/rights to dispose of the item/rights to Content. If the User refuses or fails to provide such documents, AUTO.AE may limit functionality, hide/remove Listings, and/or block the Account.

5. Age Requirement

5.1. The Service is intended for users 18+. By using AUTO.AE, you confirm you are at least 18 years old.

6. AUTO.AE Is Not a Party to Transactions

6.1. AUTO.AE is an informational platform. Unless explicitly stated in a separate written document, AUTO.AE is not a party to transactions between Users.

6.2. Users must independently verify the item (vehicle/plate), documents, seller/lessor authority, payment terms, and all transaction risks, including fraud risks.

7. Listing and Content Rules (General)

7.1. By posting Content/Listing, the User represents and warrants that:

• the User has all rights and lawful grounds to post it;
• information is accurate and not misleading;
• Content does not violate third-party rights or applicable law.

7.2. The burden of proof regarding legality, rights, and accuracy lies with the User.

7.3. Availability and accuracy: Users must post only current, genuinely available offers and keep Listings up to date. Business Users additionally must:

• post only vehicles/plates/services that are actually available for sale/rent;
• within 24 hours after a sale/transfer/unavailability, mark the item as sold/unavailable or remove the Listing.

7.4. No duplicates: The same item must not be listed more than once by the same User or related accounts unless explicitly permitted by Service functionality.

7.5. Item-related materials: Listing materials must relate to the specific item. Non-item-related promotional materials may be rejected unless explicitly approved in writing by AUTO.AE.

8. Prohibition of External Contacts and Links in Listings

8.1. In Listing descriptions and any public fields it is strictly prohibited to post:

• website/landing links;
• email addresses;
• phone numbers;
• messenger/social media usernames or links;
• QR codes;
• any methods intended to move communication outside AUTO.AE.

8.2. This prohibition also applies to photos/videos (including watermarks, overlays, frames, captions, or "hidden" contacts).

9. Moderation, Editing Rights, and Enforcement

9.1. AUTO.AE may (but is not obliged to):

• review, edit, structure, and change Listing categories/attributes;
• reject, limit visibility, "freeze", hide, or remove Listings;
• block/limit Accounts and features;
• apply measures against manipulation, abuse, and suspicious activity;
• request documents and confirmations.

9.2. AUTO.AE may refuse to disclose reasons for moderation decisions unless required by law.

9.3. Images and quality: Users must comply with image quality rules. AUTO.AE may penalize/restrict images or other content it deems inappropriate, misleading, or non-compliant.

10. Paid Services, Wallet, Stripe, No Refunds

10.1. Private Users: publishing Listings is free; paid features are promotion services within AUTO.AE.

10.2. Business Accounts: Listing publication is paid — AED 5 per publication event plus AED 2 per day while the Listing remains active (unless the interface states otherwise for a specific plan/package).

10.3. Wallet top-ups and service payments are processed via Stripe. The User agrees to Stripe's terms and procedures.

10.4. Promotion services (where available in the interface):

• Ultimate (5 days) — AED 200: price highlight, refresh, large photo, "Special Offer" block, fixed at top of search results
• Deluxe (5 days) — AED 140: price highlight, refresh, large photo, "Special Offer" block
• Plus (5 days) — AED 80: price highlight, refresh
• Stickers: up to 3 per Listing, AED 10 per sticker
• Refresh: AED 10

10.5. No guaranteed outcome: promotion does not guarantee a specific ranking position, number of views/leads, or a completed deal.

10.6. No refunds: all payments and Wallet top-ups are non-refundable, including unused Wallet amounts, except where a refund is strictly required by applicable law.

10.7. AUTO.AE may change pricing, package composition, and conditions by updating parameters in the interface.

11. Intellectual Property and Website Materials

11.1. All AUTO.AE materials (including texts, images, videos, UI/UX, design, software code, databases, structure/selection of information, algorithms, brand elements, and AUTO.AE trademarks) are protected by law and belong to AUTO.AE and/or licensors.

11.2. Users may use AUTO.AE materials only for personal and non-commercial purposes (viewing, caching, printing/saving limited fragments for personal use). Any other use (copying, publishing, distributing, modifying, commercial use) is permitted only with prior written consent of AUTO.AE.

11.3. Scraping/parsing, database extraction, reverse engineering, circumvention of limitations, and using AUTO.AE data/results to build competing services are prohibited without written permission.

11.4. It is prohibited to create, organize, or allow any references to AUTO.AE/the website/brand in advertising or other materials (including websites) outside the Service without prior written consent of AUTO.AE.

12. User Content License

12.1. By posting Content, the User grants AUTO.AE an irrevocable, worldwide, perpetual, royalty-free license (with the right to sublicense) to use, copy, adapt, format, publish, distribute, and otherwise use the Content as necessary to operate and promote AUTO.AE (including marketing and partner distribution).

12.2. The User confirms they are authorized to grant this license and that the Content does not infringe third-party rights.

12.3. If photos/videos/materials are created by AUTO.AE employees/contractors (where such service is provided), such materials belong to AUTO.AE, and the User may not use them outside AUTO.AE without written permission.

13. Privacy and Communications

13.1. Personal data processing is governed by the AUTO.AE Privacy Policy: https://auto.ae/privacy-policy/

13.2. The primary communication channel is email.

13.3. The User agrees to receive service and marketing emails from AUTO.AE. The User may opt out of marketing emails via an unsubscribe mechanism (if available) and/or by contacting [email protected].

14. Third-Party Services and External Links

14.1. AUTO.AE may display third-party links/integrations/ads. AUTO.AE is not responsible for such resources, their content, or services.

14.2. Any relationship with third parties is between the User and the relevant third party.

15. Disclaimer of Warranties and Limitation of Liability

15.1. The Service is provided "AS IS" and "AS AVAILABLE." AUTO.AE does not guarantee uninterrupted, error-free operation or that the Service meets User expectations.

15.2. AUTO.AE does not guarantee the accuracy, completeness, or timeliness of User-posted information and is not responsible for errors/omissions in Listings.

15.3. To the maximum extent permitted by law, AUTO.AE is not liable for direct/indirect damages arising from use or inability to use the Service, including loss of profit, data loss, or reputational harm.

15.4. Liability cap: to the maximum extent permitted by law, AUTO.AE's total liability for any claims related to the Service is limited to the amount actually paid by the User to AUTO.AE during the 90 days preceding the event giving rise to the claim. If no payments were made — AED 0.

15.5. Nothing in these Terms excludes or limits liability that cannot be excluded by law and does not deprive Users of non-waivable rights under applicable consumer protection laws.

16. Indemnity

16.1. The User agrees to defend, indemnify, and hold harmless AUTO.AE (including its employees and contractors) from any claims, losses, damages, penalties, costs, and expenses (including reasonable legal fees) arising from:

• the User's breach of these Terms;
• the User's Content/Listings;
• infringement of third-party rights;
• inaccurate information or fraudulent conduct by the User.

17. Notice & Takedown (IP and Illegal Content Complaints)

17.1. If a rights holder or other person believes Content infringes rights (copyright, trademarks, image rights, defamation, illegal content, etc.), they must send a notice to [email protected] including:

• claimant identity and contact details;
• a description of the rights and supporting documents;
• exact URLs/IDs of the disputed content;
• requested action (remove/restrict/correct);
• a good-faith statement.

17.2. AUTO.AE may request additional documents, temporarily restrict content during review, and/or remove content where infringement appears likely.

18. Claims Procedure and 180-Day Time Limit

18.1. Claims must be sent to [email protected].

18.2. Time limit: claims must be submitted within 180 days from the event/circumstances giving rise to the claim. After that period, AUTO.AE may refuse consideration unless mandatory law requires otherwise.

18.3. AUTO.AE responds within a reasonable time (typically up to 30 calendar days, if additional review is not required).

19. Force Majeure

19.1. AUTO.AE is not liable for failure or delay caused by events beyond reasonable control, including provider outages, governmental actions, sanctions/restrictions, network failures, accidents, war, epidemics, and similar events.

20. Changes to These Terms

20.1. AUTO.AE may amend these Terms unilaterally. The updated version becomes effective upon publication at https://auto.ae/terms_of_use/ unless stated otherwise.

20.2. Users are responsible for reviewing updates. Continued use of AUTO.AE constitutes acceptance of the updated Terms.

21. Governing Law and Jurisdiction

21.1. These Terms are governed by the laws of the United Arab Emirates.

21.2. Unless mandatory law provides otherwise, all disputes shall be subject to the courts of Dubai, UAE.

21.3. AUTO.AE may seek injunctive relief and protection of intellectual property rights in any competent court in any jurisdiction.

22. Final Provisions

22.1. If any provision is held invalid, the remaining provisions remain in force.

22.2. AUTO.AE may assign its rights and obligations under these Terms to a third party (including in case of reorganization/transfer of business) by publishing a notice in the Service.

22.3. Business Users may be subject to additional written terms (contract/invoice/offer). In case of conflict, special terms prevail only to the extent they specifically govern the relevant matter.
